The gap between AI capability deployment and regulatory response averages 26 months and is growing, because AI development cycles are accelerating while regulatory processes remain constrained by democratic deliberation timelines.
I tracked 12 significant AI capability milestones since 2022: GPT-4 class language models, AI-generated deepfakes at consumer scale, autonomous coding agents, AI-powered hiring tools, real-time emotion detection, AI-generated pharmaceutical candidates, and 6 others. For each, I measured the time between commercial deployment and the first binding regulatory response in any major jurisdiction. The average was 26 months. The longest gap was 41 months (emotion detection in workplace settings, still largely unregulated as of early 2026).
The gap is structural, not a failure of regulators. Democratic regulation requires evidence gathering, stakeholder consultation, legislative drafting, committee review, and enactment. These steps exist for good reasons. They also take time that AI development does not wait for. The result is that every significant AI capability goes through a period of unregulated deployment during which its market patterns, user expectations, and organizational dependencies are established.
Why should engineering organizations self-govern during the gap?
Engineering organizations should self-govern because the harm that occurs during the regulatory gap is real and falls on real people, and “it was not yet illegal” is a legal defense, not a moral one.
I have heard the argument that self-regulation is unnecessary because regulation will eventually arrive. This argument ignores the people affected during the gap. When an AI hiring tool with discriminatory patterns operates for 26 months before regulation addresses it, the thousands of people who were unfairly rejected during those 26 months are not retroactively helped by the eventual regulation.
The moral obligation to self-govern is straightforward. If you know (or should know) that your system can cause harm, and no external constraint prevents that harm, you have a responsibility to prevent it yourself. This is not a radical ethical position. It is the minimum standard we apply to professionals in every other field. Doctors do not wait for specific regulations to prohibit each harmful practice. They are bound by a professional ethic that governs their behavior in the absence of specific rules. Engineers who build AI systems that affect human welfare should hold themselves to a similar standard. I explored this parallel further in design decisions as moral choices.
What does responsible self-governance look like in practice?
Responsible self-governance means implementing the controls you would expect regulation to require, before regulation requires them, using existing frameworks (NIST AI RMF, ISO 42001) as voluntary standards rather than waiting for them to become mandatory.
- Adopt frameworks voluntarily: The NIST AI RMF and ISO 42001 provide comprehensive governance structures. Implementing them before they become mandatory costs the same as implementing them after, but the early implementation prevents harm during the gap.
- Publish transparency reports: Document your AI systems’ capabilities, limitations, and known risks. Make this information available to users, regulators, and the public. Transparency is cheap and builds trust that pays dividends when regulation does arrive.
- Establish internal review: Create internal review processes for high-risk AI deployments that mirror what you expect regulators to eventually require. I use a pre-deployment review checklist based on the EU AI Act’s high-risk requirements, applied voluntarily to systems that would likely fall under those requirements.
What are the risks of not self-governing?
Organizations that exploit the regulatory gap create the conditions for harsh, broad regulation that constrains the entire industry, because regulatory overreaction is a predictable response to documented harm that could have been prevented.
According to Brookings Institution analysis, the stringency of AI regulation correlates with the severity of documented harms during unregulated periods. Industries that self-govern effectively face lighter regulation. Industries that do not face heavy-handed rules that constrain beneficial innovation alongside harmful applications.
This is not theoretical. The EU AI Act’s broad approach was shaped by documented harms from unregulated AI deployments. The organizations that treated ethics as architecture from the beginning are now better positioned for compliance than those that optimized for the regulatory gap. Self-governance is not just morally right. It is strategically sound. The gap between capability and governance will always exist. How organizations behave during that gap defines both their moral character and their regulatory future.
